Welcome to PlayPlan. These Terms & Conditions ("Terms") govern your access to and use of the PlayPlan website, mobile experience and related services (the "Platform"), operated from South Africa. By creating an account or using the Platform you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Who we are
PlayPlan is an online marketplace that connects parents and event organisers ("Parents") with independent suppliers of children's-party services ("Suppliers"), including cakes, decor, entertainment, venues, photography and related categories. PlayPlan is not the supplier of any party service; we facilitate introductions, communication and lead delivery.
2. Accounts
- You must be at least 18 years old and able to enter into a binding contract.
- You agree to provide accurate information and to keep your account details up to date.
- You are responsible for activity that takes place under your account and for keeping your password secure.
- We may suspend or close accounts that breach these Terms, abuse the Platform, or harm other users.
3. Parents — using PlayPlan
Parents can submit a free party brief describing the date, area, services, budget and preferences for an event. PlayPlan uses this information to match the brief with relevant Suppliers. Parents are free to review, message and book any matched Supplier. Any contract for party services is concluded directly between the Parent and the Supplier — PlayPlan is not a party to that contract.
4. Suppliers — using PlayPlan
- Suppliers must be legitimate businesses or individuals legally entitled to provide the listed services.
- Suppliers warrant that listings, pricing, portfolios and credentials are accurate and not misleading.
- Suppliers are solely responsible for the quality, safety, insurance, licensing and delivery of their services.
- Suppliers may not bypass the Platform to avoid lead or service fees once introduced to a Parent through PlayPlan.
4.1 Credits and lead unlocks
New Suppliers receive 5 free credits on sign-up. Thereafter, Suppliers may purchase credit packs to unlock Parent leads and access full contact details. Current pack pricing is shown in the Supplier billing area and may change with notice. Credits are non-refundable, non-transferable and have no cash value. Unused credits do not expire while the Supplier account remains active.
5. Payments
Credit-pack purchases are processed by our payment partner Paystack. By making a purchase you also agree to Paystack's terms. We do not store full card details on our servers. Prices are quoted in South African Rand and include VAT where applicable.
6. Bookings between Parents and Suppliers
Any quotation, deposit, cancellation policy, refund, scope of work or dispute relating to a party booking is a matter between the Parent and the Supplier. PlayPlan does not guarantee the availability, quality, timing or legality of any service offered by a Supplier and is not responsible for the performance of either party.
7. Acceptable use
- Do not post unlawful, misleading, harassing, discriminatory or harmful content.
- Do not impersonate another person or business or misrepresent your affiliation.
- Do not scrape, reverse-engineer, overload or interfere with the Platform.
- Do not use the Platform to send unsolicited marketing communications.
8. Reviews and content
You retain ownership of content you upload (briefs, photos, logos, messages, reviews) but grant PlayPlan a non-exclusive, royalty-free, worldwide licence to host, display and use it for the purpose of operating and promoting the Platform. You are responsible for ensuring you have the rights to any content you upload.
9. Intellectual property
The PlayPlan name, logo, design, code and content (other than user-supplied content) are owned by PlayPlan and protected by intellectual-property laws. You may not copy, modify or create derivative works without our prior written permission.
10. Disclaimer and liability
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, PlayPlan disclaims all warranties, express or implied, including fitness for a particular purpose. PlayPlan will not be liable for indirect, incidental, special or consequential damages, or for any loss arising from a Parent–Supplier engagement. Nothing in these Terms limits liability that cannot be excluded under South African law, including the Consumer Protection Act 68 of 2008 where applicable.
11. Termination
You may close your account at any time by contacting us. We may suspend or terminate access where you breach these Terms, where required by law, or where continued access would harm other users or the Platform. Sections that by their nature should survive termination will do so.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or via the Platform. Continued use after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the Republic of South Africa, and the parties submit to the non-exclusive jurisdiction of the South African courts.
